POLICIES & PROCEDURES

BYLAW I. SBA GOVERNING COUNSEL VOTING, ABSENCES, & ELECTRONIC COMMUNICATIONS 

SECTION 1. METHODS OF VOTING 

Voting shall take place in person, at meetings of the Governing Counsel, via a voice vote; show of hands; or other methods approved by the Parliamentarian in accordance with Roberts Rules. Members may move to reflect a vote in the minutes and to have the votes attributed to individual members by name. Electronic voting shall only be used if a quorum of the Executive Board unanimously determines the vote to be an emergency; a member of the Executive Board shall initiate the vote electronically. 

SECTION 2. ABSENCES 

Attendance at all Governing Council meetings is required for all members of the Governing Council unless excused in advance by the SBA President. Absences should be communicated to the SBA Vice President of Communications at the earliest available time. If not communicated promptly, the absence will be unexcused. The President has the sole discretion to determine whether an absence is “excused” or “unexcused.” Excused absences shall not amount to more than (2) two Governing Council meetings per semester for members of the Governing Council or two (2) Governing Council meetings and two (2) Executive Board meetings for members of the Executive Board. If more than the allotted excused absences are used, the SBA President shall initiate removal discussions at the next Governing Council meeting. The Parliamentarian shall begin this discussion if the SBA President is the party for which the removal discussion is about. 

For purposes of Section 2, excused absences are absences that have been communicated to the Vice President of Communications in accordance with the time requirement in Section 2. All other absences shall be considered unexcused and can qualify the member for immediate removal. 

For purposes of Section 2, Governing Council meetings and Executive Board meetings are defined as meetings for which the date and time have been set two (2) weeks in advance. 

SECTION 3. ELECTRONIC COMMUNICATIONS 

Upon a motion and second from members of the Governing Body, communications from an electronic medium shall be summarized by the VP of Communications and added to the meeting minutes. The medium must include all members of the SBA Governing Body (GroupMe, email chain, etc.) and does not include committee communications. See also ListServ Policies 2024 Students.docx

 

BYLAW II. T-SHIRT/MERCHANDISE & LICENSING WAIVER POLICY 

SECTION 1. STUDENT LEADERSHIP AND INVOLVEMENT CENTER POLICIES 

The Student Leadership and Involvement Center (SLIC) must approve any designs for T-shirts or other merchandise created by student organizations. 

T-shirt and other merchandise designs must be submitted to SLIC before any items are made/printed. Designs should be submitted to SLIC for approval at least 2 weeks before the printing date

The CU Involved approval form is linked here. After the form is processed, SLIC will notify the student organization of approval or denial by email. 

Any student organization that creates and distributes T-shirts or other merchandise without prior approval will be in violation of SLIC’s policy, and the student organization (including SBA) will be responsible for the consequences (e.g., losing funding, etc.). 

The Creighton University logo and the Bluejay and Jays symbols are registered and protected trademarks of Creighton University, protected by both the Department of Public Relations and the Sports Information Office, as well as the US Patent Office. No alterations are permitted on the University seal or logo. This policy helps to ensure immediate recognition, the maintenance of appropriateness, and the prevention of commercial use without compensation to the University.  Slight alterations are occasionally permitted on the Bluejay. 

Registered student organizations, as defined by the University, using the names, marks, logo, seals, and/or symbols of Creighton University in any commercial venture, whether fundraising or promotional, are required to seek prior approval from the SLIC and Public Relations & Information Services Department by completing a T-shirt/Merchandise Design Approval and Licensing Waiver Form. 

Products sold or given away bearing the trademarks of the University and the names or logo of a registered student organization, for the sole benefit of that organization, are exempt from a royalty fee charged for commercial ventures. These products must be purchased from licensed vendors whenever possible.   

SECTION 2. SBA POLICIES 

SBA creates and sells general Creighton Law merchandise in an official Creighton Law Store as a fundraiser to fund all student organizations and SBA events that CSU funding cannot be used for (e.g., alcohol, event prizes, etc.). By allowing SBA to be the sole distributor of general Creighton Law merchandise on the official Creighton Law store, all student organizations and the student body benefit from all funds raised. 

Therefore, General Creighton Law merchandise shall be reserved for the SBA to create and produce for fundraising purposes. General Creighton Law merchandise shall be defined as the logos and designs approved by SLIC and Creighton Communications that only include the Creighton Law name or likeness.  

Student organizations who would like to create and produce merchandise for purchase shall include their student organization name on the merchandise. Student organization merchandise shall be defined as any Creighton Law merchandise that includes the student organization’s name and/or logo with the Creighton Law logo, name, or likeness. Unlike the Creighton Athletic logos, the Creighton Law name can be on the same plane of the merchandise item (e.g., above, below, etc.). 

Student organizations may choose to submit their student organization merchandise designs for approval and submission to SLIC and have SBA facilitate their merchandise sales on the SBA’s next Creighton Law merchandise store. Those who choose to have their student organization merchandise listed on the official Creighton Law merchandise store shall receive the designated profit margin of the merchandise purchased with the student organization’s logo/designs. To start the process, submit the student organization information, designs, and mock-up SBA form 

Student organizations who choose to do independent merchandise sales may do so if using CLC-licensed vendors and include their student organization name on the merchandise in accordance within the definition of Creighton student organization merchandise. Student organizations that decide to produce and sell general Creighton Law merchandise will be subject to a 25% reduction to their semester SBA funding.  

Student organizations may distribute free general Creighton Law merchandise to Creighton Law students at events and other outlets but may not receive a profit or have the merchandise go toward fundraising efforts. Student organizations who are profiting from the distribution and sale of general Creighton Law merchandise will be subject to the 25% reduction of SBA funding described in the above paragraph.  

Below are examples of a general Creighton Law logo/design and the Creighton Athletic Logos that may not be used on the same plane as any other text or Creighton Law logo. There are no restrictions on where a student organization may put their student organization name/logos and Creighton Law name/logos.  

Examples of General Creighton Law General Logos

  • A general Creighton Law logo includes the use of Creighton University School of Law or shorthand alternatives.

Prohibited Athletic Logos

  • Can have athletic logos on different plane, but they cannot be altered in any way.

    • E.g., cannot put Creighton Law and/or the name of the Student Organization below, above, or in front of it.

Example of use on a different plane: Creighton C on the front of the shirt, Creighton University School of Law ______ Student Association/Society logo on sleeve

Permissible Use of General Creighton Law Logo on Student Organization Merchandise

  • Permissible because the Student Organization’s name is listed underneath the Creighton Law School logo.

  • Permissible because the Student Organization’s name is listed underneath the Creighton Law School logo, and the Creighton Athletic “C” logo is on a separate plane.  

Impermissible Use of General Creighton Law Logo on Student Organization Merchandise

  • Impermissible because the merchandise is missing the name of the Student Organization producing the merchandise. 

  • To be permissible, the name of the Student Organization must be listed somewhere on the merchandise.  

BYLAW III. STUDENT ORGANIZATION FUNDRAISING 

SECTION 1. CREATION OF FUNDRAISING EVENT 

Fundraising events should be registered with CU Involved. Student organizations must indicate in CU Involved event submission if the event is a Fundraiser.  

SECTION 2. OFF-CAMPUS FUNDRAISERS AND SPONSORS 

If your organization wants to ask Companies or Organizations off-campus to be fundraisers/sponsors, you need to contact Sarah Giacomini (sarahgiacomini@creighton.edu).  

SECTION 3. BAKE SALE OR FOOD FUNDRAISERS 

Bake Sale or Foods for a fundraiser are allowed, but all items sold must be baked by the organization or its members. No pre-purchased items may be sold unless they are purchased. You must follow proper food-handling guidelines and gain catering exclusivity for this through the catering exclusivity form on the CU Involved Forms Page  

SECTION 4. RAFFLES 

50/50 raffles are not permitted in the state of Nebraska and will not be approved as fundraisers because it is considered gambling.  

All 50/50 raffles are not allowed for Creighton organizations unless you are raising money for a non-profit organization.  

SECTION 5. MERCHANDISE 

See Bylaw II, which governs this fundraising section.  

SECTION 6. TRAVELING EXPENDITURES 

If you are traveling and need cash to spend but do not want to bring cash, you may visit Creighton Federal and get a cash card, similar to a visa card. The money will be pulled from your account and placed on a card for you to take for that trip.
